This End User License Agreement ("Agreement") is a legal agreement between you ("User", "you", or "your") and Gonga Inc. ("Gonga", "we", "us", or "our") governing your use of the Gonga platform, including all related services, features, and integrations (collectively, the "Service").
By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the Service.
Subject to the terms of this Agreement, Gonga grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business operations. This license does not include the right to sublicense, resell, or redistribute the Service.
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

The Service may integrate with third-party services, including but not limited to QuickBooks Online, Gmail, Google Drive, Shopify, and Lightspeed. Your use of these integrations is subject to the respective third-party terms of service and privacy policies. Gonga is not responsible for the availability, accuracy, or practices of third-party services.
When you connect a third-party service, you authorize Gonga to access and retrieve data from that service on your behalf, solely to provide the features of the Service. You may disconnect any integration at any time through the Service settings.
You retain all ownership rights to your data. By using the Service, you grant Gonga a limited license to process, store, and transmit your data solely to provide and improve the Service. We will not sell your data to third parties.
The Service, including its design, features, code, and documentation, is the property of Gonga and is protected by intellectual property laws. This Agreement does not grant you any rights to Gonga's trademarks, logos, or brand elements.
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime.
To the maximum extent permitted by applicable law, Gonga shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Either party may terminate this Agreement at any time. We may suspend or terminate your access to the Service immediately if you breach this Agreement. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.
We may update this Agreement from time to time. We will notify you of material changes by posting the updated Agreement on the Service or by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Agreement.
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
